01 Scope, Provider and Acceptance

These Terms of Use and End User License Agreement (“EULA”) govern the use of the VolleyFit mobile application for iOS and Android and the related services. The provider, licensor and contracting party for the use of the app is:

You expressly agree to this EULA when registering. Users who registered before this version takes effect will be asked to review and accept it again. If you do not agree, you may not continue to use the app and may delete your account.

This EULA is concluded solely between you and Alexander Beitz. The terms of the applicable app store additionally govern the acquisition of the app and any in-app purchases. Information about the processing of personal data is available in our Privacy Policy.

02 Description of Services and License

VolleyFit supports training, communication, and team and club organization in volleyball and fitness. Core features – including personal workouts, exercises, statistics and creating or joining groups and clubs – are free of charge. Advanced features (“Premium”) may be enabled for groups and clubs. The current feature set is described in the app and at volleyfit.app/preise.

2.1 License Grant

For the duration of this EULA, we grant you a limited, non-exclusive, non-transferable and non-sublicensable right to use the app as intended on compatible devices that you own or control. You may use the app for private or commercial purposes, including as an athlete, coach, physiotherapist, team or club, in each case for your own internal purposes.

In particular, you may not resell or commercially provide the app to others, offer it as your own software service, or copy, modify, decompile, reverse engineer or attempt to derive its source code, except to the extent that applicable mandatory law or relevant open-source licenses permit such activity.

2.2 Store-Specific Scope

For the iOS app obtained through the Apple App Store, the scope of the license is further specified in Section 11. This EULA does not contain usage rules that conflict with the Apple Media Services Terms and Conditions in effect on the effective date of this EULA.

03 Registration and Account

  • An account is required to use the app. Your information must be accurate and kept up to date.
  • Login credentials must be kept confidential and must not be disclosed to unauthorized third parties.
  • Minimum age. Independent registration and use of the app without involvement of a third party is permitted from the age of 16. Younger users may only use the app with the consent of their parent or legal guardian; within the app, this consent is evidenced by a linked guardian account. Without such a link, the health features (daily check, pain reports, body measurements and comparable analyses) are not available. Details are available in the Privacy Policy.
  • An account is not transferable. You may delete it at any time in the app under Settings → Account → “Delete account”.
  • If you use the app for a company, club or other organization, you confirm that you are authorized to use it and to take the relevant actions on that organization’s behalf.
  • Responsibility for groups and clubs. Whoever creates or administers a group or club decides how its members' data is processed — who is admitted, which roles are assigned, and which coaches gain access to health data. The administering person or club is the data controller for these decisions. You warrant that you obtain the necessary consents — in particular from parents or legal guardians of underage members — and that you inform members about the processing. We provide a consent template for this purpose.

04 Premium Subscriptions and In-App Purchases

4.1 Purchase and Payment Processing

Premium is offered exclusively as an auto-renewable subscription through the in-app purchase systems of the Apple App Store or Google Play. Distribution, payment processing, invoicing and the precise role of the applicable store operator are governed by that store’s terms and the information shown in the purchase interface. Your payment method is charged exclusively through your Apple or Google account.

4.2 Group and Club Subscriptions

Monthly and annual subscriptions are offered for groups and clubs. Available tiers provide a specified number of simultaneous Premium activations (“slots”), which may be assigned to your groups or clubs and reassigned within the app. A group subscription and a club subscription may exist at the same time. A slot may be assigned only by the creator or another authorized administrator of the relevant group or club.

4.3 Prices, Term and Renewal

  • The price, taxes, billing period and included services are displayed in the store’s purchase interface before purchase.
  • The subscription renews automatically for the selected monthly or annual billing period unless it is canceled through the relevant store account in time before renewal. For Apple subscriptions, cancellation generally must occur at least 24 hours before the end of the current period to avoid the next renewal.
  • The relevant store charges the renewal in accordance with its terms; Apple generally charges the account within 24 hours before the end of the current period.
  • Upgrades, downgrades and any prorated adjustments are handled by the relevant store.

4.4 Cancellation

You may cancel a subscription at any time in the subscription settings of your Apple or Google account. These settings can be reached in the app under Settings → Subscriptions → “Manage subscription in store”. Deleting your app account does not automatically cancel a store subscription. After cancellation, Premium remains available until the end of the paid period and is then disabled. Your groups and other data remain available unless you delete your account.

4.5 No Free Trial

No free trial is currently offered for regular Premium subscriptions. Voluntary activations for individual groups or clubs, for example for testing or partner purposes, may be withdrawn at any time, are not store subscriptions and do not create a right to permanent access.

05 Withdrawal, Refunds and Warranty

5.1 Withdrawal and Refunds

The terms and procedures of the store through which a purchase was processed govern the handling of withdrawal and refund requests. Any mandatory statutory withdrawal, refund and consumer rights remain unaffected.

  • Apple: Requests may be submitted at reportaproblem.apple.com in accordance with the Apple Media Services Terms and Conditions.
  • Google: Refunds are governed by the Google Play refund policies.

If you have questions, contact us at support@volleyfit.app. The specific warranty and refund provision for the iOS app is set out in Section 11.4.

5.2 Statutory Warranty

Statutory warranty rights apply. Nothing in this EULA excludes or limits any rights to the extent such exclusion or limitation is prohibited by applicable law.

06 User Content, Obligations and Third-Party Terms

6.1 Content and Acceptable Use

  • You may not submit content that is unlawful, abusive, discriminatory, harmful to minors or infringes the rights of any third party.
  • You are responsible for your content. You grant us the limited, non-exclusive right necessary to operate the app to store and technically process that content and display it to the users you select.
  • Attacks on the infrastructure, automated extraction, circumvention of access restrictions and any abusive use are prohibited.
  • We may restrict or remove unlawful content and content that violates this EULA.

6.2 Third-Party Terms

When using the app, you must comply with all applicable third-party agreements and terms. Depending on the features you use, these include in particular the Apple Media Services Terms and Conditions or Google Play terms, the terms of your mobile and internet service provider, and the terms applicable to Sign in with Apple or Google, Firebase, Google Maps/Places and any other third-party services identified in the app. You must not use the app in a manner that violates any such terms.

07 Health-Related Features

Features such as Daily Check, pain reports, body measurements, workload management (ACWR), athletic tests and training analytics are provided solely for general information, documentation and training organization. VolleyFit does not currently use HealthKit or HomeKit. The app is not a medical device and does not replace medical, physiotherapy or other professional advice, diagnosis or treatment. You should consult qualified medical professionals if you have symptoms or before making health-related training decisions.

08 Availability, Maintenance and Support

We aim to provide high availability but do not guarantee uninterrupted or error-free operation. Maintenance, development, security measures and disruptions may temporarily restrict availability. Features may be changed or discontinued to the extent legally permissible and reasonable for you; the essential scope of an active Premium subscription will be maintained for the paid period.

Alexander Beitz is solely responsible for maintenance and support services relating to VolleyFit to the extent required by law or specified in this EULA. Support is available at support@volleyfit.app or by phone at +49 179 4156859. Section 11.3 additionally applies to the iOS app.

09 Liability

We have unlimited liability for intent and gross negligence and for damage resulting from injury to life, body or health. In the event of ordinary negligence, we are liable only for a breach of material contractual obligations whose performance is essential to the proper performance of the agreement and on whose performance you may regularly rely; in that event, liability is limited to the damage typical for this type of agreement and reasonably foreseeable.

Liability under the German Product Liability Act, for guarantees, fraudulent concealment of a defect and under other mandatory law remains unaffected. Liability to consumers is not limited beyond what applicable law permits. The clarifications in Sections 11.4 through 11.6 also apply to claims relating to the iOS app.

10 Term, Termination and Suspension

  • This EULA continues for an indefinite term. You may terminate it by deleting your account. A store subscription must also be canceled separately through the applicable store. Tip: Before deleting your account, you can export your data in the app under Settings → Account → “Export my data” — this is no longer possible after deletion.
  • In the event of a material or repeated breach, we may suspend access or terminate the account after prior notice. We may act without prior notice in the event of a serious breach, security risk or legal obligation.
  • Your right to use the app ends when this EULA terminates. Mandatory statutory rights and claims that have already arisen remain unaffected.

11 Mandatory Additional Terms for Apple Users

This Section applies to the iOS or iPadOS version of VolleyFit obtained through the Apple App Store and prevails over any conflicting provision of this EULA.

11.1 Parties and Responsibility

You and Alexander Beitz acknowledge that this EULA is concluded solely between you and Alexander Beitz, and not with Apple. Alexander Beitz, not Apple, is solely responsible for the VolleyFit licensed application and its content. This EULA does not contain usage rules that conflict with the Apple Media Services Terms and Conditions in effect on July 25, 2026.

11.2 Scope of the Apple License

The license granted to you is limited to a non-transferable license to use VolleyFit on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The licensed application may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing if Apple makes those options available for VolleyFit.

11.3 Maintenance and Support

Alexander Beitz is solely responsible for providing maintenance and support services for VolleyFit as specified in this EULA or as required under applicable law. You and Alexander Beitz acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to VolleyFit.

11.4 Warranty

Alexander Beitz is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If VolleyFit fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for the licensed application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to VolleyFit. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are the sole responsibility of Alexander Beitz. Mandatory statutory rights, including any claims against Apple in its capacity as seller, remain unaffected.

11.5 Product Claims

You and Alexander Beitz acknowledge that Alexander Beitz, not Apple, is responsible for addressing any claims by you or any third party relating to VolleyFit or your possession and use of VolleyFit. These include, without limitation, product liability claims, claims that VolleyFit fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation. The liability of Alexander Beitz is not limited beyond what applicable law permits.

11.6 Intellectual Property Rights

You and Alexander Beitz acknowledge that, in the event of any third-party claim that VolleyFit or your possession and use of VolleyFit infringes that third party’s intellectual property rights, Alexander Beitz, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of that intellectual property infringement claim.

11.7 Export and Sanctions Compliance

You represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.

11.9 Third-Party Terms

When using VolleyFit, you must comply with all applicable third-party terms of agreement, including the Apple Media Services Terms and Conditions and the terms of your mobile and internet service provider. Section 6.2 also applies.

11.10 Apple as Third-Party Beneficiary

You and Alexander Beitz acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right – and will be deemed to have accepted the right – to enforce this EULA against you as a third-party beneficiary.

12 Final Provisions

12.1 Governing Law

This EULA is governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection laws and mandatory jurisdictions of the country in which you have your habitual residence remain unaffected.

We are neither required nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12.2 Changes

We may amend this EULA with effect for the future if legal, technical or functional developments require an amendment and it is reasonable for you. We will notify you in the app of material changes. Where renewed consent is required, the new version will take effect for you only when you expressly accept it.

12.3 Severability

If any provision is wholly or partly invalid, the remaining provisions remain effective. The invalid provision will be replaced by the applicable statutory rules.

12.4 Language Versions

This EULA is provided in German and English. Both versions are intended to have the same meaning. In the event of a discrepancy, the German version prevails to the extent mandatory local law does not provide otherwise.
